What is the difference between hiring a conveyancer and a property lawyer?

Conveyancing is the process of transferring legal title (ownership) of land from one person to another. Licensed conveyancers are not always lawyers.  They are licensed to perform part of the legal work associated with a real estate transaction provided it does not go beyond “conveyancing work” as defined in the Conveyancers Act 2006. Typically, a conveyancer’s role is to prepare and lodge all the legal documentation required to transfer a title or register changes on a title.

What does a property and conveyancing lawyer do?

While conveyancers perform only “conveyancing work”, property lawyers who undertake conveyancing work can take care of any legal work and provide any necessary legal advice associated with or related to a conveyancing transaction.

Buying or selling a property can be a relatively simple process if you have representatives who know what to look out for to best protect your interests. There are a number factors that need to be considered when buying or selling a property, some simpler than others. As property lawyers, we have a deeper understanding of the law and can provide you with advice on matters that a licensed conveyancer cannot. For example, if you are assisting your child to purchase a property by lending them money, we can not only assist with the purchase of the property, we can assist you with drafting a loan agreement and provide you with advice on how to best proceed with the matter so as to ensure your financial interest is protected. Or if you are looking to purchase an investment property, we can not only assist you with the purchase settlement, we can provide you with advice and assist you with setting up a purchasing entity that is going to be most tax effective for you. Our aim at Cahill Rowe Conveyancing is to provide you with all of the advice you need to complete your property transaction in one place.

Engaging a good property lawyer in Geelong

When a real estate matter goes beyond the standard conveyancing work or turns into a legal dispute, a conveyancer must refer their client to a qualified property lawyer for further assistance. Hiring a professional property and conveyancing lawyer at the beginning of your conveyancing transaction ensures you receive comprehensive advice through all stages of the property transaction, potentially preventing any legal disputes or sales falling through due to incorrect paperwork or lack of comprehensive advice.

Conveyancer costs versus property lawyers costs

Typically, conveyancers charge lower fees than property lawyers.  However, conveyancers cannot offer the full breadth of services that a property lawyer can. At Cahill Rowe Conveyancing we pride ourselves on keeping our prices competitive with the local conveyancing market.
